hi. Currently, wala pong non-compete clause sa employee contract ko. And to my knowledge, wala po ako alam kung meron. pero sa contract ko, may nakasabi na kailangan ko i-follow ang employee handbook na nilalaman ang rules, regulations, policies and practices ng employer. Question, pede ba nila ilagay dun ang non-compete clause at valid ba yon?

Kung may nakalagay sa EMPLOYEE HANDBOOK mo . na may sinasabi tungkol sa "non compete clause" .then kailangan mong sundin ito.

Yes. This is a valid exercise of company prerogative. When you signed your employment contract, you agreed to all the conditions stipulated in it, including the provision on following the employee handbook.

Thus, if the employee handbook has a non-compete clause, you are obligated to abide by it. You can always opt not to follow it after leaving the company, but they may (if they have the resources to burn) go after you for your actions. They can also opt to put you on their blacklist, which might negatively affect background checks done on you by future employers.
