Hi, I was hired by a BPO last May 20, 2013. We started training and underwent the transition phase (before production).

On Aug. 17, 2013, I was part of a group that was advised we did not pass the transition phase because we failed in one metric. We were given the following options:
1. Resignation
2. Termination
3. Transfer to another account if we pass the validation for that account

We chose the 3rd option and placed on floating status and we continued to receive our salaries. On November 4, we had our validation with another account and was advised to wait for the next training date.

We have not received any advise from the company since. The last salary I received was on March 15, 2014. On Mar 27, 2014 and Mar 28, 2014 we received letters containing the following:

"Since August 17, you were expected to be on the production floor. However, you failed to inform your supervisor and MOD/SLC/FA of your whereabouts.
It was reported recently that you allegedly committed offense against our policy: three consecutive NCNS/AWOl or unauthorized absences will be subject to disciplinary action up to termination."

from aug30, 2013 up to march 15, we've been receiving or monthly pay.
april 3, we adhered to the hearing. they said they have to get the money back in whatever way possible. we dont have the money anymore,. we dont know what to do, are we suppose to pay that or is that really our right to be paid since they kept us waiting for that long and they never really contacted us or instructed us further since nov 4
Need your advise please.

You have a document stating that you were put on floating status?

If yes, then you should have been separated (with benefits) by February. You would not need to pay back any amount, and you would be entitled to other benefits.

If no, then they should have sent you an RTWO around August, or at the latest, November. The delay is their negligence.

we just have received the rtwo last march 26. but with regard to the signing of document that we will be on a floating status, im afraid there's none. but they regarded our status as floating, there's just no documents that they had us signed.

"They regarded our status as floating" - says who? Maybe you interpreted it differently.

Without the document of a floating status, you might have to pay back the salaries given to you. Generally a floating status is a leave without pay.

In that case they were right in sending the RTWO, but negligent in the delay.

if that's not a "floating status" then what is it called when they say that we have to wait until the next account will be available for us to join in?

Without a signed document, that is not legally a float status. You may be entitled to file a claim or complaint for constructive dismissal.

what if, we're proven to be constructively dismissed employees? do we still have to give back those salaries that was given to us?
