Nagtrabaho ako sa isang company for 4 months. I passed my resignation letter last February, a month before ung effectivity na nakalagay sa letter. Last March 10, inasikaso ko na ung clearance at employent certificate. For two weeks finafollow up ko ung progress ng COE ko. Ngayong mag three weeks na, biglang sinabi nila na hindi sila nagbibigay ng COE for employees na hindi nakatapos ng 6-month contract. Is it okay to demand for the COE although sabi nila cleared naman na daw ako at kapag may future employer na, pwedeng ibackground check na lang ako dun. Meron ba sa Labor Code ung Non-Issuance of COE for Probationary Employees?

Walang provision yan sa LC.

Pero check mo din sa policy ng company tungkol sa hindi pag-issue ng COE.

Naging empleyado ka so meron kang karapatan makakuha ng COE dahil katunayan yan. Pwede ka magreklamo sa DOLE kunsakali, at mas gugustuhin ng employer mo na magbigay ng COE kesa makasuhan pa at magbayad ng mas malaki.
