Hi, I am currently employed in a call center/ BPO company. Previously, all of us are excused for being absent whenever we have immediate family members who become sick so long as we are able to prove it, e.g., presenting a valid med cert. Now however, our operations manager is saying that they won't allow those instances to be excused, meaning, we can be issued a corrective action form, which could lead up to termination. Is there no provision in our Labor Law that those absences be excused, like caring for a minor son or daughter, or wife or husband? What if no one is able to care for them during those times. Are we supposed to leave them to suffer/ die and still come to work or else lose our source of income? Pls help. I can understand if they will take away our "bonus" privileges or perks because of those scenarios but to possibly be terminated seems unfair.

There are workarounds to that.

You may use your earned Vacation Leaves or if not allowed (for whatever reason), you should contact your HR to seek clarification and to provide a fair resolution to your concerns.

Does this mean there is a very disturbing loophole in our Labor Law? Because basically this means, we get get terminated because we wanted to take care of our sick kids, or wives. Isn't it also part of a child's rights to be cared for when sick? or even just cared for period. Isn't that in effect hindering us from performing our lawful duties to our children? thanks

As an employee, we have committed to work for our company. But the law provides us 5 days SIL which can be used to care for our sick members. Or in the case of solo parent, we have solo parent leave thru DSWD office.

if you have a valid reason, even if you go on AWOL, they might ask you for an explanation but if your reasons are valid I dont think they will terminate you.
