A friend of mine resigned last july. She got her certificate of employment already at after po ng 1 month na encash nya na ung lastpay nya after ma process ng company nya ang clearance nya. May voucher din ung lastpay nya n may proof that she was cleared n tlga s company nila. After a month, sept, lumabas o na audit ang work nya na may mga nawawalang pera. Last week po nkreceive sya ng letter notatized na magbayad sya ng nwlang pera kung hindi idedemanda daw po xa. Ang question po, may habol p po b company sa kanya ? Pwede p b sya kasuhan ng qualified theft khit may clearance na sya at cert of employment at mkuha kya n last pay nya? Need p po b nya sagutin yung demand letter Need your advice.

NOT AT ALL. The company already CLEARED HER OF ALL ACCOUNTABILITIES. It is company's negligence. Disregard the compliant and present all clearance and quit claims evidence. Make your day no worries.

in my opinion, it is still possible to go after her if the company can prove that the information became known after the certificate was issued. besides a crime is not absolved by a clearance.
