Good day po,

Just wanna ask kung pwede bang file ng Estafa
kasi nakuha na nia lahat ng pera pero di po tinapos ang project around 50% lang or civil case for Breach of Contract.

Ganito po nangyari..This contractor is referred by Architect friend na kasama niya mismo sa work.
Nagtiwala ako kasi si contractor din kinuha ni Architect na gagawa ng bahay niya at construction of appartment ng relatives ni Architect.meaning 3 ang projects ng contractor nauna muna yun apartment ng isang buwan din sabay ginagawa ang bahay namin ni Architect..

to make the story short abondon nia and 2 projects niya.sakin continue but yun nga tinakbuhan din ako nun kuha na nya lahat ng money.

now dahil bahay ko naman tinuloy ko nalang pagpapagawa at nakipag usap din si contractor na he will pay later basta itago lahat ng resibo.
verbal lang usapan alang written contract,sabi ko sige but if you fail to comply your duties i will file a case base sa written contract nation before we start the project.

now tapos na time for singilan na,pahirapan na say mahagilap,kasi pinapapunta ko sya para sya mag compute ng total cost ng mga resibo that in my computation e 390,000 pesos.

by this big amount can i file a Estafa,Breach of contract, collection of sum money and pwede din kaya mag complain sa PRC para matanggalang ng lisensya?

what is the step by step na gagawin
ko po to file a case.my received payment letter ako na nagsasaad na tanggap niya mga payment ko sa kanya with his name and signature

labag po sa batas ang kahit sino, kahit engr pa yan, ang pumasok sa pangongontrata ng construction kung wla siyang PCAB license.. search mo nalang sa google ang site ng CIAP tungkol sa bagay na yan.. sila po ang agency na humahawak sa may kinalaman sa construction.. mayron dn silang arbitrators kung gusto mo magsampa ng complain

engRR...thank you very much for the information regarding PCAB license...may maidadagdag pala ako na kaso against him.. upon checking he or his company is not a member and not registered.
i'll try to read more about it.

i am unsure what the procedure is in the P.I. i employed a contractor to build a 2 bed bungalow for my wife & myself.We agreed a price & signed the contract, the work was fine & the project was on schedule but now the contractor says he needs more money to finish the project. He has taken the workers of site & there are no materials left there. Should i employ a quantity survayor to estimate the amount spent on the project sofar because i think he was using the payments i made to him to fund other projects. Is he in breach of contract?
