good day po, kailangan ko lang po ng advice kasi yung kaibigan ko po nagkasagutan sila ng supervisor nya dahil sa pagsita sa kanya sa trabaho, nasuspende po ang kaibigan ko ng 30 days. dahil po dun nagfile po ang kaibigan ko ng illegal dissmisal case sa labor, hindi po nagkaroon ng settlement yung company at kaibigan ko. sa counter affidavit po na fniled ng company gusto po nila madismiss na yung case at pagbayarin ang kaibigan ko. ano po ang pwedeng mangyari sa kaibigan ko pag hindi nya tinuloy ang kaso, posible po ba na makulong sya?

Since your friend is only suspended, it is illogical to file illegal dismissal. Illegal Suspension would have been a better choice. I don't think your friend will be jailed but he could pay damages if the company can give justification for their claim.
