gudday..my nkapag sabi po sken n di ko na daw kailanagan mag pa annul. article 34 ginamit namin. nagsinungaling po kami n nagsama na kami ng 5 yrs pero ang toto po wala pang 1 yr kami mag bf at di kami totong nagsama. hiwalay n po kami ngayon 2 yrs n. at 2 yrs lang kami ngkasama bgo nghiwalay.gus2 q po sana ipawalang bisa ang kasal nmin.
totoo po b na hindi n nmin kaialngan ng annulment kundi void lang daw po?

was your marriage recorded in the local civil registrar and in the nso?

if you are planning to remarry, it is necessary for a judicial declaration that your marriage was void. the presumption is that your marriage is valid until declared void. you can be made liable for bigamy if you marry again.

wala pa po aq balak pakasal. gus2 q lang po maging single ulit at mapawalan bisa ang kasal q. ano po ba mga procedur para mapa void q? my record po kami sa nso.

moderator

your remedy is to file a petition in court for annulment based on the absence of a valid marriage license. you will have to provide evidence that you did not live together for 5 years. most annulment cases based on this ground have a good chance. good luck.
