Hi. I have been working on a company. I have signed a probationary contract for 3 months. The contract has ended but they are insisting that i should render a 15 day work extension because I failed to notify them for a month that i will not renew my contract.
When I was coached by my Team Leader a month before, I told him that I would not renew my contract.
They are insisting that end of contract is the same with resignation. Is that true. Thank you very much.

yes you should have notified them as that's the same as resigning.

Basically a probationary contract will be 6 months, but because your employer makes it 3 months only, then you are not required to render 30 days notice because you did not resigned. It was your employer who put you on end of contract.

you are legally required to render 30 day notice. when the 3 month period ended, you became a regular employee because you were not terminated by the employer.

I would like to ask whether the 30-day notice before resignation is applicable to probationary employees? Is there such a thing as a resignation which is effective immediately? If yes, when is it applicable?

Yes 30-day notice is still required even if you are a probationary employee.

How about if at the end of the probationary period, an employee is offered regularization. may an employee refuse and ,thus, not report to work the following day?

he should notify his/her employer that he refuse the offer and that he will no longer be coming to work.

imo, that would be a resignation and requires 30 day notice.

the end of a probationary contract does not end the employment relationship. in fact, on the very next day after the probationary period, the employee is automatically a regular employee.
