jhoy, in what stage of the proceedings are you? still at Preliminary investigation with the prosecutor. what you should focus on is to file your counter affidavit.

i believe your act should be considered falsification, not estafa. either way it is bailable, but dependent on what is actually charged by the prosecutor.

if the case is filed in court, it is likely that it will be reported to the nbi.

if you refuse to settle with the company, and you are convicted, you will have to pay.

include it in your counter affidavit, that assuming the facts to be true, the proper charge should be falsification.

one question pa atty, malakas po bA ang laban ko kung i state ko sa counter ko na ang president ng companyang un ay hindi maaring ihabla ako dahil association sila at dapat my board resolution muna galing sa board members bago ako kasuhan.. sa tingin nyo po ba madidismiss ito dahil walang karapatan ang president na maghabla sakin dahil di naman nya personal na pera un kundi ng association?
