Dati po akong may work sa alabang. may kasamahan po ako sa trabaho na humingi ng tulong sa loan nya as a c0-maker. Nag-resign po ako last december at nlaman ko na hindi nya pala nabayaran yung utang nya at nag-abroad na sya, at yung isa pa nyang co-maker ay lumipat na ng bahay. may natanggap po akong sulat na summon na hindi ko naman napuntahan nung takdang araw.. nayon po, may natanggap na naman akong sulat na "decision" na ako na ang magbabayad ng pagkakautang nung kasamahan ko dati sa trabaho.. anu po ba ang dapat kong gawin? is this small claims court? the decision un-appealable.

the sheriff will send a demand to you to pay the award. if you do not, he will write to banks to garnish your bank accounts. if none can be found, he will look for your registered assets such as land, cars, etc. if none, then your personal assets in your house. if none can be found, he just makes a report.

since you received a summons, you were given the opportunity to be heard and because you did not attend to the case, then the court could proceed. a co-maker is solidarily liable.

whatever losses you suffer, you can demand from the person who acquired the loan.
