Arresto Menor

Good day!

I just want to ask if what are the grounds for the prosecutor to dismismiss a case even there has not been any arraignment or mediation between parties after the case was filed? It seems that the prosecutor who handles the case is being biased. Wht would be the best thing do and can we have or request that the case be handled by a different prosecutor? Your timely response is very much appreciated.
