Hi I just want to know the difference between the two. Also would like to inquire about my issue, I already signed a consultancy agreement but I wouldnt want to continue with it anymore. I was suppose to start next month. Can I cancel it? I intend to cancel it because I dont like the terms (not written on it), They are offering consultancy agreement with no benefits,not 13th month, no leaves. I read in the labor code that all contractual employees can enjoy these benefits but then why does this company offers consultancy with no benefits? is that possible? What shall I do I if I would like the agreement to end since I dont even start with the employment? Hope you could help me.

Being a consultant is different from being a contractual.

Consultant (in a company) would mean someone whom the company seek advice in terms of a certain project or department. For example, a company may hire a marketing consultant for its marketing department to oversee or advice what would be the best marketing plan for the department.

Consultants' employment varies. It may be a full-time, part-time or retainer. He/ she may or may not be given 13th month and other mandated benefits. It depends upon the agreement of the company and the consultant.

A consultant also directly works with the management.

On the other hand,

A contractual employee is someone who works for the company for a period of time (mostly 1-5 months) and it is a rank-and-file position.

Are you hired as a consultant or a contractual?

Hi Thanks for answering my queries. I am hired as a consultant, as you said no benefits no 13th month but with a period of 6 months only.

Another question please..I already signed the contract, however, my current company offers me an option that changes my decision to resign. I will start on employment with the consultancy agreement next month, is there any way that I can revoke this employment? Makakasuhan ba ko?
