Gusto ko lang iraise yung concern ko about the property na na-acquire namin (lot only). Ang concern is, the time na mag execute kami ng Deed of Absolute Sale ang seller mismo ang nagdeclare ng hangganan ng property, kaya naman binakuran namin knowing na yun ang declared na sukat, nirequest na namin yun before sa seller na sukatin muna para malinaw ang hangganan, ngunit tumanggi sya, ngayon, nagkakaisyu kami sa area na ibibigay para sa kanal, dahil from the very start ng transaction walang daan ng kanal sa area, ngayon pinasukat sa Geodetic Engr ang lupa at lumalabas na sobra ng 9 sq m ang sukat. Gusto ko lang malaman ang aking karapatan sa lote. ang gusto kasi nila sa pagitan ng lote namin magkaron ng kanal,ayaw ko naman pumayag, dahil s pagkakaalam ko walang kanal ang plano sa lupa, kung lumagpas man ng 9 sq m sa harap ng bahay bawasin dahil si naman kwadrado ang sukat ng lupa. sana naman mabigyan nyo ako ng linaw na nababatay sa ating saligang batas ukol sa Deed of Sale na pinanghahawakan ko, bagamat walang technical desc. na available dahl wala pa subdivided title..Sad

The best thing to do is to have it subdivide the property (mother title) to determine the extent of your ownership (individual title) over the undivided property. Pasa sa ganun magawan ng paraan or plano ang daanan ng canal, to be fair to all.

Further, hinde po pwede yung owner lang ang mag declare ng extent ng property nyo, you should consult it sa Geodetic Engr regarding the real extent of your property considering na hinde pa na divide yung property.
