Arresto Menor

I have tendered my resignation last July 2013 and my effectivity is August 15, 2013. every year.. the company gives anniversary bonus to employees. the company's anniversary is August 31.

They have already drafted the Board resolution. Is it not against public policy that they have to to specify in the BR that only current employees employed as of august 31 are entitled and that I will not receive? considering that the benefit actually accrued since august of last year and it actually forms part of my salary considering it is given for a long period of time already?

Is this not discriminatory since this is the first time also that they will provide a date in the BR to set the parameters?

PLEASE HELP ME.

moderator

on its face, it seems valid, but if you will contest it in the nlrc, you'll have to prove that it's really part of the salary and not dependent on other factors like performance.
