Good day po!.ask ko lng po sana kung anong hakbang po ang maaari kong gawin para makapagbigay po ulit ng sustento ang AMA ng anak ko?.di po kami kasal at 5 years old na po ang anak ko at sya po ay lalake!.naghiwalay po kami bago mag-isang taon ang anak ko at may trabaho po sya noon sa pilipinas!.may kasunduan po kami sa barangay at nagkapirmahan na susuportahan Nya ang aking anak 3000 pesos kada buwan!.pinirmahan din po Nya ang BC ng anak nmin noon nung ako'y nanganak!.after po nun n naghiwalay kami ikinasal po siya at nagkaroon na rin ng anak!natigil po ang sustento nung mawalan sya ng trabaho at naintindihan ko yon!.january 2013 nag trabaho po sya sa UAE,nagpadala po siya una at huling padala ay April taong 2013 sa halagang 1500 pesos lang sa kadahilanang marami pa raw syang binabayarang utang!.naaksidente siya at naoperahan ang braso nitong mayo Lang kaya di sya nakapagpadala na dhil wala ulit syang trabaho at nitong July isang buwan na ulit syang nakakapagtrabaho at di pa sya nagpaparamdam sa sustento!.ang sabi sa akin ng asawa Nya na kung sya nga di Nya inu-obliga n magpadala o magbigay ung asawa Nya ako pa kaya na di Nya asawa..(babae po ung nagsabi)ano po ba ang maaari kong gawin dahil di sila nauubusan ng dahilan at sinabihan pa ako ng asawa nya(babae) na kung gusto ko raw magdemanda eh di idemanda ko daw sila!.sustento lng naman ang hinihingi ko!.sana matulungan nyo po ako!.marami pong salamat

Dear Atty.,

Good day!

Would like to seek professional advice. I have a live in partner now and we have two children. But before we live together, he has a live in partner. They have three children. The girl brought the kids in Mindanao because that time the girl wanted to separate with him already. To cut the story short, we are giving our financial support monthly. The problem is, the girl always wanted to increase the amount of support. She always told us, sort of black mail that she will file a case to my live in partner. She will send it to the office of my partner. Ayoko ng gulo at mastress ng sobra ang partner ko kaya ako ang nakikipag usap. My partner signed the birth certificate of hisTWO kids only. He has a good job but we have plenty of monthly dues and pinagkakasya ko lang. I always prioritized the financial support kasi iba ang ugali nung girl. My question is, how much is the average amount to give as a financial support to his sons? Ayoko po kc ng gulo/ filing case kasi nakikipag usap naman kami ng maayos at nagpapadala ng monthly support sa kanila.

It is not in the law as to how much but if ever the girl will file for a case (economic abuse), you just have to prove that what your partner is giving is only what his salary could afford

Thank you for the response. But would like to know up to what extent of his salary? The girl has a good job, she is a manager, I don't her reasons. Actually, the kids are not with her. The custody of the three children is with her mother in Mindanao where we sent the support monthly. Is there any bearing to her for this case? RA 9262 - Violence against Women and their Children is I think the file she mentioned me before. Economic abuse to be filed on my partner? Though we are sending our monthly support? Kindly enlighten me.

It is not specified in the law how much. It depends upon the agreed amount

Thank you. How about the custody is not with her. Is there any bearing for this? Can she still file a case though we are sending a regular support? As I would like to stick on the latest amount we sent to them. For this year we have increased it three times. She is texting me that she will file a case. Is it better to wait for that? As I think every time the girl wants to increase the amount she will do so and will send again a sort of black mail.

As long as you are sending your support, you don't have to worry. Let her file a case if she wants to. Just make sure you have a proof that you are sending support e.g bank deposits or receipt in remittance center

I have some of the deposit slips and recipts in remittance center. Some receipts was lost. But they knew that we sent it regularly (every 15th of the month). How about if she file a case, my partner won't be send to jail naman po? and my fear is baka manggulo siya sa office ng partner ko?
