Being sued by the employer because the employee quit

Good day po sa lahat.

Mejo kumplikado po...sana po matulungan niyo ako.

I was working for a private company as a tutor... I think magaling po ako sa ginagawa ko...so there was a former co-worker who started his own business and convinced me to work for him. He asked me to work full time for him and quit with my current company. I trusted him..so I quit with my company and chose to work for him. He offered me a salary higher than what I'm getting...that was what I thought. After weeks of working with him I realized...mas maliit pala ang sahod ko sa knya dahil sa dami ng workload n binibigay niya sa kin...so I decided to quit.

Nung pina-pirate po niya ako..he offered me my 1st month of salary as his advance payment...I agreed and signed something. When I decided to quit...I already worked for a month..so I don't owe him anything. He paid me one-month in advance and worked for a month.

Nung umalis ako...bigla niya kong tinatakot n idedemanda raw niya ako dahil sa pagk-quit ko...pinasakit ko daw ang ulo niya..and that I ruined his business. Binabawi niya ung binayad niya sa akin ng buo...but I worked for it...so hard, kung ibabalik ko un sa knya eh di bale libre na lang ung naging work ko sa kanya for the month that I worked for him.

Puede po ba akong mademanda just because nag-quit ako? Isn't that my discretion if I'm no longer happy with the job he offered me?

Wala po kaming agreement na dapat akong mag work sa knya for a certain period of time...most of the conversation we had were just verbal since pini-rate nga niya ako from my previous company.

Can he sue me simply because I quit from working for him and he does not have anyone to handle the job he gave me? I gave him a two-week notice to give him time to get another tutor for the students...I even recommended someone but he declined.

Please help me understand more. I'm stupid when it comes to things like this. I just want to know my right and if I really overstepped his right on any way...I want to be aware if I might get sued because of what I did.

You are entitled to the salary you worked for. No such thing as reimbursement of salary already earned.

Better double check your agreement kung may period na kailangan mo magtrabho sa kanya pero bawal naman din ang pwersahan.

Usuallu 30 days notice dapat pero i doubt kung hahabulin ka pa talaga dahil that will cost legal expenses na hinid na talaga worth it.

Thank you so much po. I checked the contract, wala po nakalagay na kailangan ko mag stay in a certain period of time.

In-email niya po ako at mini-message..idedemanda po raw niya ako kc I ruined his business....

Good morning po!
I've been reading the forum and it enlightened me. Thank you po! By the way, inquire po ako regarding sa kontrata ng asawa ko po.
We worked at the same company po- before.
Bale, pinapadala po kami ng Japan for training. 3months = 3 years bind tapos pag pinaalis po ulit for another 3 months, magiging +1year na po yung bind (so 4 years na), hanggang maka 5 years. Pag 5 years na po, stop na po ang adding ng bind so kahit magpabalik balik po sa Japan as long as running un 5 years binding contract, eh hind na po ito madadagdagan. Kaming 2 po ng asawa ko ay under ng 4 years na bind. Sa contact din po, may "surety". Ang surety po ng asawa ko ay ang mother nya since hindi pa kami kasal nung taon na yun 2009. Nakapag training po ang asawa ko ng [Jan-April] [May-Aug] at [Sept-Dec] ng taong 2009. Ang end ng contract po ay April 2013. Last February 2013 po nagpasa po sya ng RL since may dumating na Job Opportunity abroad. Nakiusap po kaming bayarang ng Pro-rated yung kontrata namin. FYI po Php400,000 po ang ibabayad kapag hndi natapos ang bind na kontrata.

Syempre hindi po sya pinayagan ng company namin. Ang reason po ng Resignation nya ay nawawalan na po ng silbi ang pagiging Licensed Mech. Engr nya dahil after 2009, wala na pong trabahong dumating from Japan sa dept. nya. Instead, kumukuha sya ng work from other team at pag wala talaga, as in nganga po. By the way, wala namang training na naganap sa Japan, trabaho po talaga ito. At masama po ang supervisor nya sa Japan, l;agi syang minumura at pinag-oot hanggang 2am. Alam po ito ng HR namin sa Pinas pero wala po silang ginawa. At year 2011, kinasal na po kami. Kaso last March po umalis na po ang husband ko abroad. Pinagsend po sya via email ng reason bakit sya nag AWOL although nagpasa sya ng RL kaso hindi po naapprove. Ngayon po, sa opis po ako po ay ginigipit ng company namin. Sa opis po nila pinadala ang letter from law office. Hindi ko po ito nireceive dahil may nakapag-advice sakin na pag nireciv ko, tatakbo ang kaso. So hindi ko po ito nireceive although sapilitan po akong pinapapirma. Hindi po ako pumirma or di ko talaga ito nireceive. Ang nagreceive na lang po ay ang HR namin. Nung makita ko po ang sobre, ang address po ay nakaaddress sa bahay po namin. Pero very unprofessional na sa opis nila ito dinala. It's like, kinorner po nila ako. Ano po ang dapat kong gawin at ang mga dapat ko pa pong ikabahala?
