Good day,

I just want to inquire if this is scenario can be considered breach of contract.

My brother is an Engineer and had a contract to build a 2-storey act house. On the contract they agreed that the contractee will pay every month on what the contractor has finished. The contractee was not able to pay them on a monthly basis and the project was not finished on the due date.

After verbal argument, even the contractee saying that "iwan niyo na lang ito", my brother decided to leave. The problem is there were no signed agreement on when he left.

Now, the contractee is asking him to pay the 1% of total amount of the contract (stated in the contract) plus the amount that the contractee paid in continuing the project.

What legal actions and are there ways for my brother to defend his side?
