House Care Taker Rights?

Hello po sa inyo, tanong ko lang po kung anu-ano po ba or meron po bang house caretaker rights dito sa Pilipinas?

Ganito po kasi ang situation, yung family ng mother ko ang naatasang caretaker ng isang house & lot of 1,000sq.meters. Tinanggap nila ang responsibility ngunit walang kahit na anong papers/document/contract na pinirmahan. Lahat po ng maintenance at bills ay galing lahat sa bulsa ng pamilya ng nanay ko, walang monthly allowance or kahit na pangmaintenance na binibigay ang owner. Higit 50 years na pong caretaker ang family ng mother ko doon, ngayon mother ko na lang. Bale, just this week(3rd week of June 2013) may kumontact sa mother ko na dapat daw by August 2013 umalis na siya at itrtry nila ibenta yung property.

Yung owner po pala ay nakatira sa US, twice lang po dumalaw in the span of 50 years. Hindi din po nababayaran ang tax. Kami na din po ang nag-aayos ng papers at tax ng bahay.

Gusto ko lang pong malaman kung may karapatan ba ang mother ko na magclaim ng compensation as a caretaker of the property for almost her entire life? Ang sinasabi po kasi ng owner wala daw silang obligasyon sa mother ko since pinatira naman daw siya doon. Ang gusto lang din naman po kasi namin iparating sa owner ay caretaker kami ng bahay at lahat ng ginastos namin for bills and maintenance eh galing sa bulsa namin which is supposedly galing dapat sa owner.

You may claim compensation by way of Reimbursement of your useful and necessay expenses for the preservation of the property, like yung bills, maintenance or other fees which is attirbutable to the preservation of the said property

Other compensation ay hinde na, baka you are thinking of separation pay, or salary accrued thereto...hinde na po pwede yan.

However, depende na rin sa may ari ng property kung bigyan kayo ng "compensation" based on moral obligation.(bale kung bigyan lng kayo) not on legal obligation.

Thank you so much for your reply. Yun lang po ang gusto naming alamin, reimbursement of all expenses would be a great help na para sa mother ko. Hindi naman po namin habol ang separation pay or salary for being their house/property caretaker. We just need compensation or as you said "reimbursement" for the money my mother invested in maintaining their property.
