tanong ko lang po kung pwede immediate ang notice of floating status?
pwede po bang effective date nya agad agad?

Follow up question Atty,

if stated po sa Notice ng Floating status na the company will pay parin yung gov't dues (SSS, PHILHEALTH and Pag-ibig) and yung HDMF(Medicare) habang nasa Floating status, then eventually upon checking with SSS na hindi up to date yung contributions and yung HMDF is nasuspend na.

in this case na di sumunod yung employer sa agreement - pwede ba yun maconsider as breach dun sa pinapirmahan?
may implications po ba ito sa status nila? (e.g. pwede po ba sila maconsider as constructively dismissed? since hindi na nababayad si employer on behalf ng employee)

ano po bang best na dapat gawin dito?

baka naman na delay lang yung pag remit sa SSS.. porket hindi updated means na hindi na agad binayaran... yung ibang company na dedelay din nang ilang bwan..

pag hindi biniyaran tapos pinangako nilang babayaran eh di pwede nyong habulin yun.. pero yung iba kong alam na naka float.. walang bayad ang mga contributions..

so, meron po ba itong implications na di na sila kinokonsider na employee ni employer? pwede po ba itong maging grounds to say na nadismiss na sila in employment? pwede po ba itong maging under ng constructive dismissal?



dagdag tanong po.
scenario po. may existing na salary loan si employee

march 1 2012 inadvice po ni employer si employee na naflfloat siya ng april 30 2012. dahil alam po ni employer na si employee ay may salary loan, kinausap nya po ito at nakipagset kung willing si employee deductkan sa salary (mar 15, mar 30, apr 15 and apr 30) to cover yung months na maflofloat sya. worst case scenario po ang usapan(na 6 months maflfloat si employee)
kinompute ni employer yung 6 monthly contribution (may- oct 2012) and dinivide into 4 equal amounts na idededuct nga po sa remaining paydates ni employee bago sya mafloat. umagree po si employee dito at nagkapirmahan po ng authorization.

paano po kung hindi pala nagdeduct si employer sa salary ni employee. di naging aware dito si employee, only to found out months after na may naaccumulate ng interest sa loan.

knowing na walang income si employee dahil floating na sya, sya po ba ang dapat magshoshoulder ng interest?
.....kasi in which wala naman siyang dapat bayaran dahil nakipagagree naman siya kay employer para tuloytuloy ang bayad sa loan niya. di lang ginawa ni employer yung share nya sa pinapirmhan sa kanya.

you can file a complaint at the SSS.

imo, a notice of temporary lay off should be given 30 days prior to effectivity.
