Buyer A partially paid our lot about a month ago. One of the neighbors (B)planted a mango tree and a coconut tree on the lot. B doesn't own the lot of course. When it was bought by A, B didn't have any objection or complaint. Recently, (this week), B wanted to uproot the trees so that they can be transferred to her lot. She realized the effort put in planting, the sentimental value, etc. Does she have the right to remove them (the trees)? What is/are Buyer A's rights in this case?

Please advise us.

Thank you.

Yes, being a planter in bad faith. He is obliged to remove all the trees planted thereon.

A has the right to appropriate the trees AFTER paying B of all the necessary expenses/cost for planting of such trees.

OR

A can ask B to remove the trees at the expense of B.

OR

A can ask B to pay a reasonable rent over the property. ( this can be agreed upon, although, the law does not say so)
