Hi...Kamusta kayong lahat?..I need help regarding the situation of my 5 year old daughter again..Me and her mom are not married and both of us are working abroad in different countries. My daughter was under the care of my mother for 3 years and they are very close with each other. Last month my daughter's mother went home for vacation and my mom brought my daughter to their place para mag bonding sila ng mama niya for a month. Prior to this, she ask my mom look for a school again for my daughter that is much cheaper. By the way, we are from visayas and her my is from manila. So my mom did what she has requested. When my mom was in her place, she just told my mom that she decided to let my daughter stay in manila under the care of her brother and sister-in-law. It was very sudden. My mom is so depress until now. Every time my mom talks to my daughter on the phone, my daughter always asks her when is she coming back to take care of her because she misses her so much and she doesn't like to stay their.My daughter's mother will go back abroad next moth and my daughter will be under the care of persons who never tried taking care of her. They have no choice because my daughter's mom shoulders the school expenses of their son..so parang utang na lood nalang yung ginagawa nila. So ngayon, lumayo yung anak ko sa lola niya who took care of her for 3 years, aalagaaan siya ng mga tao who never tried taking care of her,and babalik ang mama niya sa abroad ulit...I am very concerned about what my daughter will feel. My mother knows my daughter a lot..My mother is having separation anxiety right now and she's so much depress. My mother is so much affected emotionally because the way my daughter's mom treated her was like trash..she insulted my mom to me, she said bad things about my mom that are not true, even our daughter is still under my mom's care...We never insulted her and her family because rinerespeto namin sila kase family din sila ng anak ko. Ginawa namain ang gusto nila all the time kase we understand that the mother has the full custody of an illegitimate child even the father signed the birth certificate. Sa ngayon, linilimit na nila ang communication ko sa anak ko...Before, when my daughter was still under my mom's care, araw araw naguusap kami ng anak ko but her mom seldom calls her. But ngayon, sabi nila sa akin e schedule ko na daw ang tawag ko sa anak ko and same with my mom...Btw, the parent's of the mother of my daughter are in good terms with my mom. They are old and financially dependent sa nanay ng anak ko that's why wala din silang control sa situation...They just told my mother na hayaan at intindihin nalang daw ang anak nila...Guys,I need your help here...I need your legal advice... ano ang dapat ko gawin legally? ...THANK YOU!:-)

file custody over your daughter (pero ang drawback neto is baka ilipat yung anak mo sa ibang lugar)

1. brutal - file VAWC against lola at dun sa nanay.
2. moderate - file custody case
3. impossible? - umuwi ka sa pinas at kunin mo ng personal yung bata at itakas mo. then again, kakasuhan ka nila ng kidnapping PERO kung ikaw ang tunay na tatay, wala kang liability. (worst, may possible harassment din ito sa mga pulis so dapat malakas ang koneksyon mo)

bonus: o kaya, kausapin mo yung anak mo na siya mismo ang mag reklamo at pumunta sa police station para makaalis sa custody ng lola at nanay niya. kung magagawa ng anak mo yan, well and good. kung hindi, tiis tiis lang until na magkaruon siya ng sariling desisyon at mag rebelde sa mga evil guardians niya

unfortunately, only the mother has parental authority and right to custody over the illegitimate child. your mother can visit the child, but if the mother refuses, then you'll have to file court action to enforce it

...Thank you for your replies...me and my family understand that the mother has the full parental authority over the illegitimate child...can she still execute this authority even without her presence since she's working abroad?...she entrusted our daughter to my mother for 3 years and suddenly she just took our daughter away from her..the emotional and psychological effect to my mom is very painful.

Thank for your reply attyLLL...what if I decided to go home, can I still file a petition even that the mother of my daughter is in abroad?...will the court honor my petition even without her presence?...I always talk to my daughter by phone and she always say to me that she misses her lola (my mother) so much and she is crying while talking to me..she even say that she doesn't want to live their in her mother's house..I'm so worried about the psychological and emotional effects to my daughter.
