THREAT thru text

my attention was called by a barangay kagawad asking me to attend a conference with the lupong tagapayapa kasi daw i texted him "Ingat kasi bilang na ang araw mo"...my number was stored on his celfon and when he received the text, my name appeared on his celfon. when the secretary read the number, i recognized that it is the cell number i am using, it is a postpaid plan from a certain company and i am using it for more than 3 years.. i admitted that it is my number but i never admitted that i am the one who texted him because i really never did it. He is willing to file the case in court...i am asking a legal advice from you if what should i do with this problem and what is the consequence of this case?

Where is the act "threatened to be done" in this message,

Anyway, that's the first step, barangay mediation/conciliation.

kasi according to the complainant, DEATH THREAT daw ito and this will lead to CRIMINAL CASE.... it means the phrase "ingat kasi bilang na ang araw mo" is NOT a threat?

Siguro kung si Asiong Salonga yan or a line from an action movie, it may mean to be that.

But in Law, not all can be implied to be such unless explicitly expressed to be such. To commit a felony under the Revised Penal Code, your act (or omission) must be an exercise of your freedom with knowledge and intention

di ba sabi mo:

Besides, there's no case yet filed against you. It was just a barangay mediation proceeding.

we will have our last hearing with LUPON next week....the complainant is willing to file a case against me....he only follows the right process of undergoing three hearings with the lupon before pursuing it to the PNP and he will get endorsement from the PNP for the court...
can TEXT MESSAGE be an enough evidence for him to file a case against me?

get a lawyer, answer the complaint-affidavit by making your own counter-affidavit, from there the fiscal will determine if there is probable cause to file a criminal case against you, so don't miss your schedules at the assistant prosecutor's office

i have questions, i need help. ganito po yun ung company na pinagtrabahuhan ko before sabi sa labor ako daw po ung nagttxt ng harsh/threat message sa kanila and gusto nila ako ipblotter pero hindi po yun totoo, then nung gusto ko linisin name ko sinasabi ng company close issue, then ung ngpapanggap na ako ngtxt dn skn ng paninirang puri then the following day nakita ung simcard sa office pero hnd po ako pmunta dun kasi ngpblotter po ako sa barangay tska sa labor para dun, ngyon sbi ng company itapon n lng daw po yung simcard dahil close issue, pero walang action ginawa yung company hnd man sila ngsorry sa pgbibintang skn, kasi po ako tlga dinidiin nila na ngttxt ng harsh/ threat message pero ang hnd nila alam ngtxt dn skn yung tao. ano po gagawin ko

i receive a letter now from their attorney


they are filling a case to me a Grave death treats
if i didnt apologize to them within 5days they will file it., that the letters say..

i am worry if i apologize them i didnt do that things. and if i apologize them baka gamitin nila ito sa kaso.. 

because they told me that i posted a harsh words and deathtreats in a facebook account..

but i told them thats not me my facebook was hack! and someone hack it but they dont believe me..

they still accuse me for the case that i didnt do.


they tell me that they have the evidence of screen shot of harsh word in facebook..  



Pls help me attorneys what i gonna do..?
and can i file a case to them? and what case..


i am only 19 yearsold..


but i have the evidence now in my other facebook na kakaopen ko lang is july 6// not july 4 they are accusing me july 4,

and i have the print shot through my. facebook accnt private messges that they tell me na papatayin nila kami...


help me pls.
