Hi and Good day to all;

We need your expertise regarding this matter and we are seeking all the help that we can gather for this case.

can you consider the reasons below as grounds for annulment?

1. ex husband doesn't have nso birth certificate.
2. Marriage was more of should we say fixed marriage because they did not presented any documents such as cenomar, any meetings before the wedding.
3. Parents/ or one of his parents did not sign the parental advise.

4. ex-husband big time drug addict
5. no child support for almost 2-3 years
6. physical abuse

and lastly what if during the trial, the ex-husband lost his interest on attending the case?
what would happen?

also may i ask, if both parties doesn't have any communication at all for 5 or more years, what will happen with the marriage? can we file a case to void the marriage?

Thank you so much.

Yes. It was applied April 2010 but was out month of June 2010 and upon checking it on NSO last month, it was registered.

Thank you.

Dear Atty.

Surprised

Maybe it just not registered in time or its not his real name.

2. Marriage was more of should we say fixed marriage because they did not presented any documents such as cenomar, any meetings before the wedding.
This can happen for forced marriage no documents in hand.

3. Parents/ or one of his parents did not sign the parental advise.
How old are they?

4. ex-husband big time drug addict
Ex-husband means your marriage is already annuled right? If not he is still the husband

5. no child support for almost 2-3 years
Abandonment case

6. physical abuse
RA9262 case

and lastly what if during the trial, the ex-husband lost his interest on attending the case?

Depends on the case! but if he lost interest on attending the better for you, it will be in your favour!

also may i ask, if both parties doesn't have any communication at all for 5 or more years, what will happen with the marriage? can we file a case to void the marriage? -
Depends if you have enough evidence that the marriage is null and void!

Thank you so much.

@AWV

Thank you Sir.
Hi and Good day to all;

We need your expertise regarding this matter and we are seeking all the help that we can gather for this case.

can you consider the reasons below as grounds for annulment?

1. ex husband doesn't have nso birth certificate.
Maybe it just not registered in time or its not his real name.
from what I know ibang birth certificate ang gamit nung lalake

2. Marriage was more of should we say fixed marriage because they did not presented any documents such as cenomar, any meetings before the wedding.
This can happen for forced marriage no documents in hand.

3. Parents/ or one of his parents did not sign the parental advise.
How old are they?
they were 22 and 23 years old back then

4. ex-husband big time drug addict
Ex-husband means your marriage is already annuled right? If not he is still the husband
I see, but can we use this as one of the grounds for the annulment case?

5. no child support for almost 2-3 years
Abandonment case
Thank you Sir

6. physical abuse
RA9262 case
Thank you Sir

and lastly what if during the trial, the ex-husband lost his interest on attending the case?
what would happen?
Depends on the case! but if he lost interest on attending the better for you, it will be in your favour!
if he lost interest on attending the better for you, it will be in your favour!

*What do you mean sir? what will happen with the case?
We're going to spend big amount of money and most of all the TIME, all we wanted to know is if he losses interest or shall we say sa una lang sya magaling at maga-attend, what will happen? matitigil ba ang trial?mawawalan ho po ng saysay yung TIME at Effort pag-attend ng ANNULMENT CASE?

also may i ask, if both parties doesn't have any communication at all for 5 or more years, what will happen with the marriage? can we file a case to void the marriage? -
Depends if you have enough evidence that the marriage is null and void!
We are hearing from others that is it true that its easier to file an annulment case if both parties are not living, doesn't see or doesn't have communication at all for 5 or more years? IS this true?

AGAIN!
Thank you so much.

If proven definitely ground for annulment for falsification of public documents marriage is null and void from the start!

NO! the case will continue and if he continuesly ignore it, he will be in trouble and the annulment is likely to be granted on your favour!

RAYMOND Vincent was the name of the ex-husband.
School records and other documents was under this name.

but the birth certificate that was used is in the name of "Vicente L**a"
if we prove this, how long would this case take? and how much do we need to prepare?

That depends on the lawyer who will represent you, but I can see your case will be quicker than any ordinary annulment. Ensure you have enough evidence. GOOD LUCK! Wink
