Hi Sir,

I had my last day 3 months ago from my previous company. Since then, they haven't given me my last pay and COE. The problem is that I still have a pending SSS loan with them, and I believe that my last pay would not be enough to pay my SSS loan balance. I also know that there is a 1% penalty per month if amortization is not paid on due date.

My question is, can I ask them to pay the penalty since they've been delaying the process of my last pay?

the proper process, i think, would be for you to pay the penalty first then seek reimbursement or file a case for the penalty amount.
