nullity of marriage if the husband is a newly converted Islam

i got married in civil 2001 but after a year we separated due to some problems. We also made written agreement na hindi notarized kc bwal daw stating na wla na kming pakialam sa isa't isa if in the future we wanted to have another family. after few years, i found out that nagpacovert ung ex-husband ko to Islam and got married and have 1 child.

Almost 8 years na kming hiwalay, no communication after the separation.

I wanted to use my maiden name again and having my marriage with him be null and void. What will i do without spending too much? I heard na mahal daw ang annulment. What is the difference of annulment and nullity of marriage?

Please help me. Thanks.

first, you can already revert to your maiden name even if you are still married, but you cannot compel the issuer of your legal documents such as passport to change the name previously registered.

there are many grounds for annulment. it is best to have a lawyer review your case.

if there is any real ground other than psychological incapacity, then the cost may be substantially lower.i normally explore the issuance of the marriage license as the best bet.

if only psycho incapacity, then it can be quite expensive. 100k is a normal amount but it can go much higher.

i have my id's like SSS, TIN, driver's license and passport using my married name, even my PAG-IBIG. The offices of the above-mentioned id's told me to give them court order if i wanted to revert back my maiden name.

yup, the supreme court recently decided that these offices cannot be compelled to change your registered name without a court order. nevertheless, aside from these docs, you can use your maiden name, but the consequence may be confusion because of the discrepancy.

his marriage with his new wife is valid? i think they got married to Islam because I tried securing CENOMAR and there's only 1 marriage he got and that's ours. Meaning to say, their marriage is not registered to NSO.

marriages under islam is covered by sha'ria law. there is a different set of laws covering this. i'm afraid i am not competent to comment whether it would appear in nso.
