Rockband business- Intellectual Property Rights

We are planning to establish a Rockband rental business. Rockband is a game produced and developed by EA Games and Harmonix. The EULA of the game (software) says that it is only for personal use. How can we legalize the commercial use of the product? We will rent them out to students in game rooms. There are now existing businesses of this type. We believe that they are underground ones. We want to be legal. How can we be?

The Intellectual Property Right as protected under the End User License Agreement (EULA) refers only to ILLEGAL DISTRIBUTION by means of COPYING, REPRODUCTION and consequently sell them in the public(just like the case of pirated DVD), RE-PROGRAMMING(decoding the source code and exploit its capabilities, like hacking)the program..But this does not include how you use/abuse their program.

Just compare the situation with Original MICROSOFT WINDOWS operating systems, (win7, winxp win8), they must be used only in a single pc, but it does not mean that you cannot rent it out that PC to the public, like in the case of public internet cafe's.

So my point is SO LONG as you buy the ORIGINAL COPY of that ROCKBAND GAME and installed in a SINGLE unit and rent it out to the public, then you did not violate any intellectual rights or rules.

imo, EA would be within their rights to sue you for violation of the EULA. your recourse, if you want to be by the book, will be to ask permission from EA
