gusto ko lang po malaman kung my laban po yung case na sinampa ko sa nlrc laban sa dati ko employer kasi po na terminate ako nung january 10,2013 sa kadahilanan po na absent ako nung december 28,2012 at january 2,2013 sa kadahilanan po nagka lbm ako at nammaga ang ngipin ko,numg umabsent naman po ako sinigurado ko po malalaman ng company namin na hindi ako makakapasok nag text at tumawag po ako para naman my ipalit sakin.last january 5,2013 nakatanggap po ako ng memo na dapat explain kung bakit ako umabsent na ginawa ko naman po pero tinerminate padin po ako sa kadahilanan probitionary po ako..sa ngayon po ay medyo nawawalan ako ng pagasa dahil po nabanggit po ng atty na tumutulong sakin na maari akong matalo sana po ay matulungan nyo ako?

I second the motion.

Ganito kasi yun, yung status ng employment mo is probitionary, being as such, wala po kayong security of tenure(which means hinde po kayo basta-basta matanggal without valid or authorized cause as provided under Labor code). Being a probitionary employee, your dismissal is subject to discretion ng employer, valid or invalid man yung reason mo ang employer ang may "last say" kung tanggalin ka or not,(usually sa practice, inaabuso eto ng mga employer)

Lastly, Tuloy mo lang ang laban, baka panigan ka ng arbiter.

pwede ko ba gawin evidence yung memo ko na last december 6,2012 na ako ang ginawa team leader ng department namin kasi po kasama sa termination letter ko na di daw ako naka pasa sa evaluation ko...since from the start po hindi ako na late o umabsent sa trabaho yung time lang po na yon last december 24 po ako lang ang mag isa nag duty hindi po pumasok yung mga ka work ko ni hindi po sila napaalam kahit sa text laNG pero hindi man lang po sila binigyan ng memo,,pwede ko po ba gawin reason yun?

you have security of tenure during the probationary period, and then subject to an evaluation. it's very hard to overturn an evaluation but if you feel strongly enough the legal remedy is to file a complaint at nlrc

You can have all your evidence be presented to the NLRC to prove your cause, but, as what attyLLL says, the most important thing that you should do is to OVERTURN that "evaluation" made by your employer, which is in reality a very difficult task, kasi nga:

1. Management prerogative yun, right yun ng mga employer, whether they abused it or not.

2. Evaluation by the employer is a case to case basis, there is no uniform guidelines established under Labor laws neither court jurisprudence to that effect.

3. Pag probationary ang status mo, you can NEVER compel your employer to HIRE you, even you worked satisfactorily in accordance to the terms of employement as agreed upon in your probationary contract.

But then, nasa sayo yung last say, whether to fight it out or not.
