Hi sir/maam.
Can I be sued by the company if I decided to to file my immediate resignation? I have a one year contract And according to the contract I signed that 3 months daw po before the contrct ends dapt mag file na ng resignation letter.
My boss threatening me if I choose to leave the company immediately, hahabulin nila ako sa kumpanyang lilipatan ko. Please need your help.

Ang nasa labor law lang is at least 30 days of resignation notice. So, 3 months is too much.

Ang immediate na date of resignation is dapat ma-approve ng manager mo. Di purket nakasabi ka na magreresign ka na e, yun na yun! Me pirma dapat ang boss mo na approved na ang resignation mo pati ang effective date.

Tip ko sayo- gandahan mo rason mo sa resignation. Wag yung mababaw lang na ayaw mo na, or ayaw mo na makita boss mo..hehehe.

panu po ma,am kung hindi pinirmahan..let say mar 27, 2013 gnwa ko yung resgnation letter ko since nagemergency leave yung boss ko at that time and mar 28-29 eh holiday naman tapos apr1 di n naman sya pumask apr 2 lngme nagusap at pinasa ko resignation letter ko.. ang effectivity date nanilagay ko po is apr 25, 2013 then mag start na ako sa new company ng aprl 29.. panu po yung nagfile ako ng resgnation di niya pnirmahan..kase nga yaw nya tanggapin yung effectivity date ko na apr 25, 2013

if you do not render 30 day notice, the employer is entitled to damages.

Atty question po, in our company we have policy for probi and regular employees that they need to reder 30 days notice for resignation, failure to comply with this is non inssuance of certificate of employment. For those employees want to have immediate resignation it's ok to the company but yun nga they can't get certifcate from the company, this is for direct employees. My question is what if the employee is under manpower agency? they have their resignation immediately and did not comply to 30 days notification. We advice the agency that these employees failed to comply with our policy regarding resignation and ask the agency to apply our rules like to our direct employees for non-compliance to 30 days notice is non-issuance of employment certificate. But the manpower agency has no rules and regulation to this policy like us since these employees they deployed to us is not a probi nor regular employee of them. As per agency if these employees process their resignation to their company and they will be cleared they are subject to receive an employment certificate in their company. We know that there shoud not have an employer employee relationship between the company and third party employee but how can we incorporate to the manpower agency our rules and regulation regarding this matter in a legal way? thank you and hoping for your response.

charles, if these persons are not your employees, then you can complain to the agency about the effects of their assigned persons, but you cannot dictate to them what their employee policies should be.

the matter has to be discussed at the contract negotiation level between your company and the contractor.
