Our company merge with our their sister comapny. Many people was offered by redundancy and some are retain. I was retain with company. Due to mergeing is it possible that were working with this new entity pero wala naman po legal docs. no sec reg. In short nag merge dumami ang trabaho ng isang tao dahil madami tinanggal. Wala rin increase nangyari. Tapos ngayon po ung ibang naredundate pinabalik na dahil kulang sa tao. nakakuha na sila ng redundancy pay tapos mas mataas pa basic pay nila ngayon kesa sa naiwan na employee pero same rank lng naman.

ano po pede gawin? is there any case we can charge to the company?

me problema po ako... i have submitted a resignation letter sa employer ko... ang problema is wala xang date up to what day ako magend.. indicated lng dun ung work na tatapusin ko... ok lng ba un? And eto pa po... pwede po ba magreject ang employer ng resignation letter..?? kahit nagresign na ako pwede parin po ba akong iterminate?

trisha, ask them first if the years in your previous company will be recognized

give another letter stating that the resignation is effective in 30 days

Question:
1. some of the employee was offered redundancy tapos after 6 mos they was asked by the company to come back and work again with the same position. tapos starting nila mas higher pa sa naiwan... is that ok?

i believe that is ok. it may seem unfair, but note that your years of service are continuing whereas theirs is back to zero.

one more sir dahil nag merge kami nagmerge lang po ng work pero ung company ganun pa din po. ngayon po im planning to apply with other department kaso may ruling sila na we need to resign kung lilipat kami ng dept. di po ba illegal nyo? lateral transfer lang naman po ang gagawin dahil same company lang din naman

resign siguro don sa position then if accepted sa new position.. continuous ang years of service dapat.. better clear it with your HR.

SO pag di po sila pumayag na continous length of service pede ko po kasuhan sila sa labor? they wanted kc ibalik sa minimum wage ung salary pag lumipat ng position

di pwede babaan ang sweldo kahit ano pa posisyon non.. same company.. diminution of benefits yan.. pwede ka magsampa nang kaso..

newbie here. bagong tayo lang yung company na pinapasukan ko ngayon. i was hired here last december 4, 2012. wala akong papers na pinirmahan regarding sa pagkakahire ko. nung june 04, 2013, 6 months na ako pero wala akong clue kung regular na ba ko dito o ano. wala kasing documents na pinapirma, ang sabi lang nung manager namin, 6 months probation lang after 6 months regular na. kaso nagresign yung manager namin, yung accountant lang ang nagmamanage samen ngayon. paano ko po masesecure yung position ko or if ever na tanggalin nila ko, ano po yung pwede ko gawin? according po kasi sa mga coworkers ko na matagal ng nagtatrabaho under sa ibang company nung boss ko, wala daw contract na binibigay sa kanila yung boss namin. sana po mapayuhan nyo ako what to do. thanks!

trisha, you don't have the right to demand transfer; but if you were transferred, you should not have to resign. you can send a complaint to dole about that policy

zenki, no probationary contract at the point of hire automatically makes you a regular employee.no contract is required.

Sir, paano po un nainterview na ko ng general manager at umaattend na po ng seminar for other position kaso wala pa ko papers na transfer ako kasi they want po na magresign po muna ko para back to zero lahat. ayaw po kasi nia dumami ang lumipat ng ibang department. may laban po ba ko sa gusto ng management?
