Arresto Menor

The Local Register of Deeds refused to register and transfer ownership from a 1970's Deed of Sale from a mother to her children A and B despite having completed the requirements from BIR and City Assessor solely based on a notarized letter from the heir of C which is the brother of A and B.

Said heir is protesting:
1) that there is no copy of the DOS on the office of the clerk of court. (but the same office proved its authenticity that's why BIR was able to give clearance).
2) that they are paying land taxes only about 3 years ago til present. (From the time of sale, it was A who is paying for it).
3) that his C, his father(dec)is the sole owner

I know for a fact that the duty of the ROD is ministerial in nature.

Please give advice for future actions including the liability of ROD if there is any.

I will appreciate any help.

seems more complicated than it sounds. you can either raise the matter to the LRA legal division or file case to compel the RD to register the sale.
