Ask ko lang if ano ang rights ng mga common law partners..

sa property??

if theres infidelity happened can they both file a case against each other??

We, all know for sure girls naman talaga lagi talo dito sa set up na LIVING TOGETHER.

But I wanna know yung mga LEGAL RIGHTS ng mga common law partners.. IN CASE,. Laughing
para may idea lang po.. Smile

So your talking about live-in?

The property is owned in common, there is CO-OWNERSHIP over the property, hating magkapatid kayo. (50-50 sharing)

Infidelity issues?, sorry no right to file action to each other, otherwise there is no more distinction between the married couple and the live-in couple.

We cannot rationalized na palaging talo ang girls sa setup na live-in, for example, mayaman yung girl and na in love sya sa hardenero nila, lets say she owned at least 95% of their common property, yung guy naman owned only 5%, so, even both of them owned the property in common, still the girl can get her 95% share over the property upon their breakup.

(kawawa lang yung guy, nawalan sya ng mayaman na ka live-in) Sad

atty. if the story is infidelity??? may case po ba ang babae against sa partner?? I heard po about RA 9262.. and yes sakop ng batas kahit sila kasal.. How about case between babae kakasuhan ang lalake (kalive-in nya + yung babae ng kalivein nya)

like for example. nahuli ko si partner na may kalandiang iba, at yung babae eh habol ng habol pa din kay partner ko.. wala ako pwede ikaso?? (alam ko po hindi pwede ang concubinage at monetary damage sa case na to) pero meron po sakop ng batas sa infidelity ng both partners???

i gues wlang pwdeng i file na case againts each other unless nasa legalidad kayung pareho at nag karon ng ganyang factor. and about sa property. thou its co-owner ang senaries? depende pa din yan sa actual contributions. justifications lng ng actual shares and contributions. at yun din mismo ang maari mong makuha..

RA 9262 or also known as violence against woman and their child act, centers only with respect to VIOLENCE in form of physical(binogbog ka or yung anak mo ng asawa mo or syota mo or ka live-in mo), emotional(yung asawa mo lantaran yung pangangaliwa nya) or economic(hinde ka binibigyan or yung anak nyo ng sustento/support ng asawa mo) violence commited against the woman.

THus, to avail this, there must be VIOLENCE commited against you, in my own understanding, infidelity issues is not a violence per se, neither be considered as "emotional violence". though, there is no yet a decided case for this.

Sad to say, wala pong kaso yun, also hinde po pwedeng i treat yun na "emotional violence". im not sure, kasi nga wala pang decided case ang Supreme court with respect to that, meron lang yung physical violence and economic violence.

**hiwalayan mo na, hinde pa nga kayo kasal, eh may infidelity issues na..paano na kung kasal na kayo then yan rin ang mangyayari?..anyway, you can still post it here asking legal question on what to do, maybe by that time pasok kana sa RA9262 on "emotional violence". (pinapatawa lang kita.. Very Happy , thats life)

yun nga po e.. ang saklap po pala talaga kung idadaan sa legal lahat , talo ang walang habol..anyway hindi pala common law wife ang tawag sakin.. heheheheh kasi....

Actually, pinakuha ko po ng cenomar yung bf ko ngayon, and we found out na registered yung kasal nilang dalawa ng asawa nya last MAY 2001 po, accdg, sa bf ko secret marriage ang scenario nila.. 22 si girl at 23 si guy.. walang witness at nagbayad lang ng 3000 sa fixer, sa MANILA CITY HALL, pero ang nakalagay sa CENOMAR ay SAN JUAN CITY.


hindi ko po alam kung ano gagawin ko, though we dont have kids.. yun nga nakpag pundar na kmi ng gamit.. ( ang lumalabas kasi ngayon KABIT na ko) Im planning sana mag ipon for anulment ng kasal nila.. kaso wala ako makitang grounds..

BTW, yung ex wife nya po pala my daughter na sa new partner nya, and they living together na for 3 years na po.. I know my rights pa nga yung bf ko na magfile ng Adultery sa E-wife nya.. pero since ayaw na nila sa isat isa..Were planning na lng po for anulment..
