Deed of assignment but assignor has no valid business permit

Hi,

We entered into a deed of assignment agreement. However,upon checking, we realized that the assignor has only DTI. His business has no other valid permits. Does this make the contract void?

Absence of any valid business permits does not make the deed of assignment a void contract. Neither be a valid ground to declare the contract void.

Good day poh.. Related poh ang inquiry ko sa case na to.. We assumed balance sa home loan sa pag ibig pero wala pa sa pangalan ng first owner ung property..
Deed of assignment lang poh yung hawak namin pareho pero hindi pa naman ako member ng PAG IBIG..Hindi rin poh kami nag transact sa mismong office ng HDMF..

Void poh ba yung Deed of Assignment na hawak ko?

So kayo po yung 2nd ASSIGNEE?.

Just check and trace the Deed of assignment executed between the Property owner(1st assignor) and the 1st assignee, if that DEED was executed VALIDLY, LEGALLY, no vitiated consent, or any act that would impair the giving of both consent, then that is a VALID Assignment That same right and status would be pass upon to you by the 1st assignee by reason of that 1st assignment.

For short, if valid yung 1st assignment, valid rin yung 2nd assignment sa inyo.

The original borrower poh is yung 1st owner / 1st assignor.. Sa pangalan niya lahat yung doc's except CERTIFICATE OF TITLE kase di pa fully paid yung 2 years na kailangang mabayad para malagay sa name nia yung property..Pero na take out na nila yung unit pero di natitirahan ever since ma take out kase nasa Israel sia. .. Sya yung nag apply sa HDMF at nagbayad sa equity/dp ng property..

Tapos ako poh yung 1st assignee.. Nagka problem sia sa Israel kaya pinasalo nia yung bahay at ako poh yung sumalo..

Aside from DEED OF ASSIGNMENT na notarized naman, eh wala ako ibang pinanghahawakan.. And someone at PAG IBIG office told me na it is void since di ako member ng pag ibig at di rin dumaan sa kanila..

Maybe they do not understand the DEED OF ASSIGNMENT. Assignment of Rights lang man ng 1st assignor ang involved dito likewise, that right involves assumption of balance under the name of 1st assignor as provided under the deed of assignment dba?

Now, the problem will arise if after you fully paid the assumed balance, wherein, that certificate of title be issued in the name of the owner/assignor and not in your name. Perhaps dito kayo magaaway, kasi since nakapangalan sa owner yung Certificate of title, eh dapat mag execute sya ng DEED of sale in favor sayo na hinde ka qualified kasi nga non pagibig member ka.
