LOT SELLER WON'T PROCESS TRANSFER OF TITLE

Good day i humbly need your advise. bumili po kasi kami ng Lot and ang agreement is the Seller will be the one who will process the transfer of certifiicate of title pero ang problema ay wala pa pala itong title but tax declaration pa lang. Kelangan daw muna ipa survey ang lot para maging TCT siya pero yun lagi ang sinasabi ng Seller. Nakapag down na po kami almost 80% ng price ng lot and still wala pa TCT and mukhang hindi na inaasikaso ang pag pprocess ng transfer hindi din sumasagot sa calls or text ang may ari. Ano po bang legal action ang pwede gawin dito thanks.

anong katibayan mo na pinagpirmahan ng seller at ikaw? tax declaration document is not a legal document of ownership, it is only for the purpose of paying tax to the government. Is the lot a government lot? if yes, then there is no such thing as owner selling it to you as is considered as squatter or if gov't sell it to residents the seller is just having the possessory right, hence, a document such as deed of sale is not proper, but rather a deed of renunciation of possessory right is mostly the proper document. City planning dept. who has cognizance of the lot can be asked, or the DENR.

Thanks for the reply. Meron kaming contract to sell and verified sa municipal hall that he was the one paying the tax declaration of the lot. Hindi siya government owned. Need lang daw maayos ang bearings or boundaries macombine yun different parcel of lot before sya magawan ng TCT. Siya na daw ang magpapasurvey and transfer pero 1 year na mukhang hindi pa nilalakad.ano po bang legal action ang pwede dito para maiayos na ang documento thanks.

Well its not even fully paid yet, why would the seller process the title? Further, what you have is merely a contract to sell, asking for the title is premature

Yes its not fully paid, but the deal or agreement was to process all the necessary documents for the transfer before we pay the remaining balance. What if he never process it anymore, it seems that its not his priority after he had received the down payment he's not anwering the calls or texts and this keeps us in doubt. what would be the appropriate action for him to still accomplish what is agreed upon as soon as possible, thanks,
