Employer filed a case against me....is it legal??

Arresto Menor

Last Dec, I notified my employer that I am sick and cannot go to work, but the truth is I went out of the country. When I came back, my employer was demanding for my passport. Is this legal? And now my employer wants to file a case against me...do they have the right to do so? I need help desperately...

check your company handbook for possible policy violations.

pwedeng fraud yan, dishonesty, etc (which may be terminable).

if you're an officer or manager, pwedeng loss of trust and confidence (also terminable)

If they have filed an administrative case against you already, your resignation might not be approved until the case is completed.

Filing your resignation might be construed as an admission that you did something wrong.

And yes, you will still be liable.
