I received a summon today from MTC Taguig. My former employer is demanding me to pay 96,000 for breach of contract. There was no case or any resolution for the breach of contract. I received demand letter. I went on AWOL because I advised my absent but nobody acknowledges it. In short I said that I am terminating my employement with them with grounds under labor code art 285. serious insult by the employer, inhumane and unbearble treatment and the like. they sent demand letter requiring me to pay 96k in 5days. single parent ako at wala ako pera ala pa ako trabaho ngayon. tama bang singilin ako na wala nmn resolution ang korte na dpa ako magbayad? please help Feb 12 na po ang hearing nmin

where did art. 285 came in? how were you seriously insulted? you should have sent a resignation letter sighting that..

or dapat nag file ka nang kaso..

i guess this is a small claims case? make sure to file a 'sagot' and an affidavit to state your side. and go to the hearing. otherwise, the judge will decide based only on the evidence of the company.

when an employee does not give proper 30 day notice, the employer is entitled to damages. not replying to you is not considered an insult. but 96k is too much

Tama po small claims nga po. me basis po ba yun. napilitan na lang po ako wag pumasok. lagi po ako pinapahiya ng Team Lead ko. Pag nag aadvised po ako ng absent dinededma lang. lahat ng commendations ko at inquiries ko ignored din po. magreresign na nga po sana ako nung pinaprint ko po yung resignation sabi po sa akin mga kasamahan ko at isang TL me kapalit na nga po ako na na hire 3weeks before ako magsabi magreresign ako. kaya po nung di na naman nila ako sinagot sa advised ko kinulit ko po yung company na inaaplyan ko kung pwede na ako makapasok duon asap. di na po ako nagpakita. walan naman po tawag o RTWO ako na receive... until nagkasakit anak ko at nanghingi ako philhealth cf1 form sa HR namin. pinasurrender po sa akin ung ids at lahat ng keys sa akin tapoos naka receive ako rtwo. pinapapasok ako ng same day na ipinadala nila yung letter

sinagot ko naman po na dahil I get humiliated everyday nawalan na po ako guts pumasok. I went there personally sabi ko naman if it's required I am more than willing to render 60 days as they require pero after a month Demand letter na po pinadala sa akin 3 months salary ko daw po e maski sunugin nila ako di ako mangangamoy maski singko. Nawalan na po ako work dahil pumutok na ang demanda sa akin at naka probation pa po ako. International bank po pinapasukan ko bumagsak po ako sa background investigation. Dun po sa sagot pwede ko po ba i-counter claim ang 13th month ko tax refund at leaves? umiiyak po mga anak ko dahil sabi ng kuya ko makukulong po ako. takot na takot po sila Please help po.

nag file po ako ng answer. Sabi ko po wala talaga ako pera pambayd as i lost my job due to this. submitted na po ang kaso paano po kaya iyan kung pumabor and korte sa kanila wala po ako 96thousand. I'm just waiting ofr the decision ano po mangyayari sa nbi clearance ko paano po ako makakakuha ng ibang work kungme ganito ako record? pwede po ba ako mag file sa DOLE ng harrassment?

you can file a case at nlrc, but i doubt they will side with you.

hopefully the court will lessen the amount.

this will have no effect with your nbi records.
