ask ko lng po kung sino po ang mas my karapatan sa bahay namin,ang mama ko, papa ko o ako po? hiwalay na po kasi mama at papa ko kaya ang pinag-aawayan ngayon ung bahay. sabi po ng mama ko benta nalang daw namin, ayaw naman ng papa ko kasi po sa akin na daw ang bahay na ito.. nagugulohan lang po ako kung ano po talaga ang totoo. sana po matulongan niyo po ako. salamat po..

1st question: are they lawfully married?

If no, then they owned the property under the concept of co-ownership.

If yes, 2nd question, was there an agreement for the property regime?
A.If none then BOTH of them owned the property being classified as a community property.(Absolute Community Property)

B. If yes, the property regime will govern the ownership of the house.(Complete separation or conjugal partnership of gain)depending on what type of regime did they entered into.
