Hi atty,

Good Day!

I would like to ask for your legal expertise regarding employment contract. I have a friend who works for a company for almost two years now and they were never given/issued a contract. Is it legal to do so? Is there a violation against Labor code for companies who failed to issue an employment contract?

meron silang kontrata, wla lang papel na pinirmahan.ang ibig sabihin kasi ng contract sa civil law ay "meeting of the minds"... blah blah... eh ung fren mo e 2 years ng nagtratrabaho sa employer niya imposible namang hindi pa sila nagkaintindihan ng employer niya na empleyado siya ng huli. Ang pwedeng gawin ni fren mo ay isapapel na ang kanilang kontrata/ pagkakaintindihan....

btw, sa unang tingin, ayon sa batas, regular na empleydao na si fren mo.

mas ok nga yang walang contract.. basta sahod sya.. may payslip.. at binigay naman yung pinag usapan nila.. ayos na yan..

mas ok wala contrak it means regular n sya kase wala measurement, on the other hand pwede sya umalis anytime kase wala contract
