wala pa po sa aking ang letter na galing RD ...

Anu po dahilan at nadedenied ang isang adverse claim...

Why do you need the adverse claim where in fact there was a sale annotated in the title?

Usually adverse claim is filed by the oppositor hindi po ung buyer ng parcel of land.

Kaya siguro po nadeny.

Tanong ninyo po bakit sia nadeny sa ROD. Baka kasi hindi na po existing ung title or wala po sia sa Primary Entry Book. or Mali po ung ROD na napuntahan ninyo.

tip ko din is maghanap ka ng taga loob. sila ang magturo sa iyo paano hindi madeny ang adverse claim mo. your affidavit of adverse claim must contain all the material and necessary allegations na pasok sa panlasa ng mga taga ROD bago iyan ma approve. hindi enough iyong nasa legal form. KASI iyan din ang nangyari sa akin kaya na deny. me kulang daw na material fact na hindi nalagay.

idea lang po ito. mas better if maglapit ka ng lawyer na magaling sa real estate or registration of title. wag ka mag asa dito totally. mga tips at ideas lang ito dito s freelegaladvice.

naghahabol po kami sa lupa ng lola ko may oct po ito nakapangalan sa lola ko pero naitransfer sa tito ko with extrajudicial settlement w/ waiver of right in short pinamigay ng mga magkakapatid ang lupa nila sa tito ko pero hindi po naisama ang nanay ko kaya po kami naghahabol ang sabi po ng atty namin mag file po kami ng adverse claim sa ROD un sa form ang pinadala namin denied kasi po daw,

There was a circular issued by LRC.

Hereditary share as an adverse claim
LRC Circular No. 306, date April 27, 1977 embodies the guidelines in the registration of an adverse claim. Paragraph 8 thereof reads:

8. Hereditary share not a basis of adverse claim. It has been settled by this Commission in a string of consultas that the rights of an heir cannot be the subject of an adverse claim.The claim of heirs based solely on their rights of succession, cannot be the basis of an adverse claim on the property registered in the name of the person from whom they claim to inherit since as such, their claim is certainly not adverse to her. On the contrary, it should be in the interest of the heirs to uphold the title of the one they seek to inherit from in order to have a valid title to succeed to and step into the shoes of their predecessor-in-interest. Such claim based on successional rights, therefore, is not within the contemplation of Sec. 110 of Act 496." (LRA Consulta No. 2849)

Kaya hindi mag prorprosper ang adver claim.
