Can an appointed barangay secretary be Liable to R.A. 6713 code of conduct & ethical standard for public official & employee?

for receiving a money on videokarera without the knowledge of the council

unable to perform his duty because he plays majong more often

what if a punong parangay tolerates the wrong doing of the secretary, and for me as a kagawad want to file my grivances to the sangguniang pang lungsod.What suitable Section from the RA 6713 is to applied? thanx in advance> gud am
