Good morning po , ask po sana ako if anu magagawa ko sa problema ko.

i have a girlfriend we are living together for 3 months now she is 17 when we started living together and just turned 18 last october 28 then kinuha sya ng DSWD sa tulong ng ate nya , as far as i know she is pregnant kasi almost 3 months na syang delayed so pwede ko ba gamitin ung pagiging father ng dinadala na as basis para mailabas sya sa DSWD

so here is an update , i went there the other they we where not able to talk but she was able to signal me that she is indeed 3 months pregnant they did not let me, their reason is that the social worker who is handling her case is not there,,, im feeling that i am getting the run around.

so the question is what can i do now ? or what can she do ? and how can i tell her what to do now ? when i can't even talk to her ? and do i have any chance with a legal battle with out the help of her parents?

she has to assert herself that she wants to leave. else she is presumed to want to stay

you can also write a letter, but technically you don't have any legal personality

again, if she wants to leave, she needs to strongly assert herself as an adult.

as i said, if she is not asserting her right to leave, then the presumption is that she prefers to stay with the dswd.

if you wish to try, the legal remedy is to file a petition for issuance of a writ of habeas corpus so that she will be presented to the court.
