Hi. I want to ask your opinion regarding my situation. Here it is.

There is this commercial building built by a reputable developer in Pasig who offerred a rent-to-own commercial space . When I first saw them I asked if units are still available and that if there is already a business reserve for the one I plan to put up - let's say a nail salon & body spa. And so I was told: There are units still left and that none has yet 'reserved' a salon. I inquire about their processes on how to reserve because I want an assurance that no other similar business will be put in the building or if they have such processes. Accordingly I was told that they have a 'bus. development' department that oversees businesses to be put up for the 'purpose that there is no duplicate of business'. And so I started to give my cheques as 'reservation and so on'. After a few weeks, it came to my attention that owners of same line of business have rented the unit just beside the unit I 'reserved'. I raised my concern to the developer: I asked them that how come they are allowing to put up a salon beside me when I was told that I will be the only one to offer the services. And so they told me that this owner will provide a different service (waxing, bleaching and facial only) and that they are using a different trade name. And so with that I continue with my lease and that I have renovated my unit. After a month of operations, the lessee beside me have started renovating their place. I did not bother to check on their unit on how it is constructed since I have trusted my developer and they provide me an assurance that the services of the unit beside me 'provide different services'. But, lo and behold, when they finished, their unit, supplies, furnitures tells me that they are not waxing, bleaching and facial - that they are also a nail salon and spa! I have raised my concern to filinvest several times, but I ahve received a proper response from them. They have kept quiet, no actions were done and they just let me continue and pay my rent, while I am struggling and competing with a business just beside me.

What am I supposed to do? I wanted to file a case but I do I have one? What does the law says on commercial establishments (rents, lease, etc)? fyi - I have no contract that says that the developer will not allow other same business to be put uip there - anything to that effect. But I believe, not even written, I was already made to believe that they do 'protect' business owners. Please let me know your advise. Appreciate your response. Thanks.
