falsification of public document

Hi...i am curious if it is considered falsification of public document if we submitted a faked marriage contract in a hospital just to comply with the requirement so that my daughter will be able to used my family name (she was born under the old family code ..march 2002)..the outcome, on my daughter BC it is reflected that we are married...
if its the case (falsification), what would be the penalty??what will be my action?

we lived together for 4yrs...and now we're separated..and im married now to other woman for almost 3years... i still give support to my daughter for her basic needs, paid her tuitions, medical..etc...
in short,i am the one who carries the financial responsibilities because the mother is jobless from the very start...mabarkada...gimiks...
i also made researched...is RULE 108 applicable to me??

how come you were not able to know that your status is "married" at the time you obtained a CENOMAR for the marriage between you and then other woman?

first off, ano ba ang gusto mong gawin? have the BC of the child corrected so as to reflect that you and the mother of the child are not married?

if that is so, better contact a lawyer...

you will still be liable for support to the child, but if you want to correct the child's birth certificate to reflect her as illegitimate, then rule 108 is applicable. you have to be careful though, or else you may be putting in writing that you committed falsification.

on the hand if there will be no complainant why should you worry about changing the status of your child.

i was not married to the mother of my daughter eversince...i jst produced a faked marriage certificate so that my daughter can use my family name...

there is a complainant,the mother of my daughter..coz she's asking more financial supports aside from the monthly support,education,medical,etc...she's threatening me to file a complaint re falsification.

the mother of the daughter was the complainant? Didn't both of you submitted the faked marriage contract? in other words, both of you committed falsification...unless she wants to compromise herself, she had better keep silent, otherwise both of you will end up in jail. tell her that...

the falsification will not be cured by correcting the birth certificate. the records will still show what it was originally.

if both of you signed the birth certificate, then indeed, both of you should be held liable. or you can counter that it was the wife who did it because she did not want the child to be recorded as illegitimate, but you didn't want to marry her.

i am the one who is the informant,i am the one who signed the birth certificate...

I would try to negotiate as fair a deal as possible with the mother, or defend as best you can when she files her complaint.

rule 108 is not your remedy.

how???so, would you think if i leave "as is" the birth certificate?? if she file a case against me, what is my chance??

rather than uselessly spend for a petition under rule 108, it would be better to acquire a lawyer to help you negotiate an agreement with your wife and to provide comprehensive advise on your possible defenses if she insists on filing a criminal case against you.

actually, we already have agrement for so many times....we have it in writing with the barangay officials...but again,walang ngyari...ilang beses na ring ineskandalo ang legal na asawa ko sa bahay namin, since i worked abroad..kya lahat ng gulo at eskandalo,asawa ko ang humaharap..
ginugulo kami dahil sa pera...and lately,i received a letter from the attorney..and accusing for the falsification of public document..
kung tutuusin,she doesnt need to demand more,coz, ako ang ngpapaaral at ngprovide ng lahat ng nids ng anak ko...di ko lng alam kung bakit pa sya nangugulo..since rule 108 is not my remedy,maybe i should wait for her petition..

I have the same problem as azyqoy. The only difference is that wala namang magcocomplain sa akin. Im still with the mother of my children. same case din kami, gusto ko na maayos or ma alis yung date and place of marriage sa BC ng anak ko. What are the procedures po ba? Common na po ba itong issue na ganito sa local civil registrar? Kung magsa-submit po ba ako ng letter of request together with affidavit of no marriage sa kanila wala po bang magiging problema? may ganitong case po ba kayong alam na nag-aayos tapos nakasuhan kahit wala akong alam na magko-complain or may maghabla coming from the civil registrar itself? ano po bang magandang reason to state in my letter of request? hoping for your good advice. tnx!

meron po. kaso hindi pa ngayon. I still have plans of migrating. My main concern at the moment is yung BC po ng mga anak ko. Pano po ba ang magiging process and if ever mga magkano po ang magagastos sa BC ng dalawang anak ko. Thanks po.

you may also face the same problem that it will come out that fake documents were submitted and you may be made liable.

the proper way to correct the birth certificates is to file a petition in court for correction of entry of records. a request letter is not sufficient.
