Arresto Menor

May isang parcel of land na inuupahan po namin bale 9 po kaming tenants doon pero sa amin po ang mga bahay. Yung iba 46 years na nga pong naninirahan doon sa nasabing lupa.

Ang mga mag ari po ay 2 magkapatid, yung isa po sa kanila ay US citizen na at doon na sya naninirahan samantalang ang isa ay dito sa pilipinas pa rin naglagi.

Nung dumating po ang time na nagkasakit yung isa sa mga may ari ng lupa at sya ay iniuwi na sa probinsya,(yung nandito sa Pinas), may inatasan syang maningil ng paupa sa lupa na isa rin sa mga tenants.

Nung mamatay na yung maysakit na may ari sa probinsya, umuwi yung isang may ari (kapatid ng namatay na nasa US, isa rin sa may ari nung lupa) doon na nagsimula ang problema.

Nung bumalik na sa US yung isa sa may-ari, nagpatawag ng meeting yung tenant na inatasan noong maningil ng paupa. At sinabi nyang NABILI na daw nya yung lupa na kinatitirikan ng aming mga bahay. AT sya na daw ang bagong may ari.

Nagpakita po sya ng deed of sale. Nangyari po iyon ng hindi po kami kinausap ng totoong may ari ng lupa, at wala po kaming kaalam alam na nagka bentahan na po sila ng lupa.

Ano po ba ang mga hakbang na dapat naming gawin dahil kami po ay pinu pwersa ng umalis sa mga kinatitirikan ng aming mga bahay?

Lagi kaming hina harass nung nakabili daw ng lupa at nauwi pa nga po sa pananakit sa akin. May mga kaso din po akong naka file sa piskalya againts sa kanya na ORAL DEF., THREAT, SLIGHT PHYSICAL INJURY at UNJUST VAXATION.

is the deed notarized, and if it is, was it done properly? if you have a copy, then check out the acknowledgment by the notary. is it dated when the seller was still here in the philippines? were proper identification cards presented to the notary? did the parties actually appear before the notary? was it the actual notary who signed the acknowledgment or just a secretary?

if not, you can claim there is no basis to say the document is authentic and duly executed because it was not properly notarized.

did the dead owner have children or other heirs? was his estate properly settled? is the property titled, and if so is it in the name of both owners, and did both execute the deed of sale.
