Adultery case with child born in adultery

atty, good day to you and other forumers. I would like to get your opinion about what i should do to my case so it will be fast. I already have the birth certificate of my wife's son born from adultery. i also have pictures to prove that she committed adultery. at the moment she is now living with his so called Kabit. at first it was a very mental torture for me and our 2 daughters of what happened because we do not have any idea of what is happening until i noticed that she is pregnant and she confessed that she did commit adultery.
I almost killed myself because of it. I tried my best to keep our family even tried talking with the guy to leave my wife alone. to make the story short. everything didn't go along what i hoped it to be. they are now together and living along with the guys family. at this time i am looking for a lawyer that can help me build up my case because i found out that i need to file the case before 1 year of the childs birth.
I tried checking PAO if they can help me but found out that i am not eligible. I am working in a call center industry earns a bit higher that the minumum wage but since i am the only one who is supporting my daughters and expenses at home i do not have the means to hire an attorney. hope you can help me with this, I really want to fight for my right as i suffered too much. my family doesn't know what i've been through because i do not want to tell them about it. thank you in advance.

tnx sir, question, is Prosec/fISCAL same as lawyers? if then what procedures or steps should i follow. I really do not have idea about filing a case and never in my wild imagination that i will do it to my wife. but things have to be put into place. everyone have choices they make but with that choices have to prepare as well for consequences. another question,
*where should i file the case? i lived in pasig but they are in rizal.
*do you also have idea how much should i prepare for all the expenses for filing this case?

I apologize if i really do not have any idea on how to go about this case. i will greatly appreciate if you could advise me for my first steps on how to pursue on filing this case. I actually have nothing against the child, I even think he is mine. I also want that child to have a DNA test to make sure if he really is not mine to contest just to clear as well my conscience.
another thing, will this case remove my wife's right for my children?
I already have a copy of the childs birth certificate stating that i am not the father and both of them signed it. will it fall under falcification of public document too? or that birth certificate is null and void since i am still in the eyes of the law the father of that child unless i contest it. and if ever i will not contest the birth certificate, can i request that the name of the child be transferred in my name if found out in the DNA that i am the real father? thank you.

if you are the complainant wala bayad ang magfile nang case sa Fiscals office. You are respresented by the government.

Just go to your nearest Fiscals office and ask them how to file a case to your wife and the needed documents to do it.

but i do hope you can move on with it for peace of mind.mahirap araw2 galit ka sa kanya.file for monetary damages nalang para makapera ka sa kanila.

thank you for your assistance good sir. i am now planning to file adultery and falsification case for the both of them. my concern now is makakaabot pa kaya, i heard the guy will be working overseas, i don't want naman na my wife will just suffer the consequence. it there something i can do for him not to get out of the country? btw i am a bit moving on with my 2 daughters now. i also want to file sole custody for them. but for the child i do not know yet what to do because i really want to know if he is mine or not before i will contest him as my own child. as today they still refuse to have blood test compatability.

sir just pray that everything will go well nothing is imposible with GOD. try to follow their advice. for peace of mind, talk to the guy and your wife about their intention since she gave birth already. How about you, do you thing the child is yours? in my case i have seen pictures of the child now he's 11 months old and i can find our similarities... my problem is that i now have lots of what if's...btw, i'm just near your area.

eyzrey, i symphatize with your current condition. you can file adultery case against your wife and paramour in your city's prosecutor's office. the birth cert should have the paramour acknowledging the child to prove sexual intercourse. if it has, use it. the downside though is that the birth cert u have now is against PD 603 and may be suppressed.

Im not sure how to go around Hold Departure Order for the paramour. It is PAO who can execute such. Since you are not qualified for PAO services, ask the fiscal's office what would be your best alternative since they (NPO and PAO and even BID) fall on the same umbrella which is DOJ
