Can I file Estafa?

Hi Atty, I would like advise on this my ex borrowed money from me I am currently in the US, I have sent money through remittance, he told me that he would pay keeps on promising to the point he left for abroad in Kuwait to work I still have communication with him, I made a complaint to the Philippine embassy in Kuwait which they managed to contact him but I want to know if I could file a case for him, he owes me 175,000 pesos, I sent him promissory note through email so he could sign it but did not do it, how can you help me with this situation, I want to file a case, apparently he owes money too to his other ex which he signed the prom note actually I have a copy of it as I spoke with his ex when I went home for vacation last April. I want to take legal actions to what he did. Thanks.
