hi atty. pwd po ba mgpakasal sa isang lalaki na 10 years ng walang communication 1st wife tapos ung 1st wife ay may kinakasama ng iba?

Hindi po mahalaga kung gaano na katagal silang mag-kahiwalay. Sa korte po ang paguusapan ay ang bisa ng unang kasal ni lalaki. At kahit pa po may kinakasama nang iba ang asawa nya, hanggat hindi napapawalang –bisa ang naunang kasal mananatili po silang nakatali dito at aaari po makasuhan ng bigamy kung sakali magpapakasal ulit siya sa ibang babae.

paano po kung parehas na silang walang communication sa loob ng 10 taon at wala na silang pakialam sa isa't isa? Yung 1st wife ay nagkaroon na ng anak sa kinakasama niya?

The marriage is still subsisting, However the husband can file a petition for presumptive death of the wife. The husband can remarry again, however if the 1st wife will return the 2nd marriage will eb automatically terminated.
