Good Day! I just want to know if pwede po ba akong mag-file ng case against a person defaming my name? Pero nag'kasakitan po kami during the day when I confronted her. Ako po 'yung naunang nanakit kasi nga po sa mga hindi na tama't totoong pinag-kakakalat niya sa Barangay namin. Masyado po kasi akong nasasaktan sa mga sinasabi niya. Kahit nga po hindi totoo, parang ang mabigat sa kalooban ko na tawaging Prostitute. Gusto ko po sanang matigil ang mga paninira niya sa akin baka po kasi malaman ng Mother ko, mas lumaki pa po ang problema.

Lets make thing clear first, is she spreading hearsays about you? is that what you mean in your statement that he/she is defaming your name?

Under the Revised Penal Code of the Philippines, Slander or Oral defamation is punished as follows:

“Art. 358. Slander. — Oral defamation shall be punished by arresto mayor in its maximum period to prision correccional in its minimum period if it is of a serious and insulting nature; otherwise the penalty shall be arresto menor or a fine not exceeding 200 pesos”.

In the case of Daniel Victorio and Exequiel Victorio vs. The Hon. Court of Appeals and The People of the Philippines (G.R. Nos. L-32836-37 May 3, 1989), the Supreme Court defined slander as follows:

“The term oral defamation or slander as now understood, has been defined as the speaking of base and defamatory words which tend to prejudice another in his reputation, office, trade, business or means of livelihood”

In your case, Im assuming that she is circulating to your barangay that you are a prostitute is seriously a degaring remark, it would amount to grave oral defamation which could impose her the higher penalty.

Yung nasa baba na article, maraming ganitong paragraph sa RPC, itatanong ko po sana kung bakit yung punishement ay aresto mayor in its maximum tapos prision correctional in its minimum period, e di ba po mas matagal yung prision correctional sa 6 years ata habang 1 year lang yung aresto mayor. Magpapaturo po sana Sir, kung bakit ganun.

punishments are given in ranges years to give the judge discretion.

arresto mayor in its max 4-6 mos. prision correcional in its minimum is 6 mos to around 2 years

so grave slander is punishable with 4 mos to 2 years.
