atty. ask ko lang po kasi gulong gulo na po ako isa po akong employee ng isang shoes company ang problem ko po natukso po ako kumukuha po ako ng pera sa store yung benta po. sasampahan po ako ng boss ko humihinge po ako ng tawad sa kanila at gusto ko po makipag usap na bayaran ko nalang unti. atty. please i need your advise.

try your best to settle your debt with your employer. borrow money so you can pay it back in full. hopefully, he will be dissuaded to file a case since you paid what you got. request, but don't insist that they sign a quitclaim.

don't suddenly resign or go awol without paying. that's the surest way that they will file the complaint.

do not sign any confessions, only admit to a 'debt' to your boss, but do not admit or write down that you stole anything.

meron po akong kapatid na ofw na pumasok na gwardiya pansamantala noong 2007 dahil sa 45 plus na siya dahil bago lang siya sa trabahong iyun ay medyo paeasy lang ang trabaho niya minsan sa palitan nila ng tao ay hindi nakarating on time ang kapalit niya kaya yung baril na sa pagiingat niya ay itinabi niya sa lalagyan ng kapalitan pero ng bumalik sya ay sinabi ng kapalitan ay wala yung baril sa lalagyan kaya kinasuhan siya ng agency ng qualified theft.hindi na siya nagpakita sa agency sa dahilang pagkakaalam na paraan lang ng agency marahil iyun para siya magresign.nakaalis siya muli noong december 2007 at nakabalik ng 2009 ngayun kumuha siya ng nbi pero may lumabas na record sa nbi tungkol sa kasong qualified theft kaya di niya ngayun malaman ang gagawin niya.ang tanong ko po ay kung pwede po ba yung ganun na kahit wala ang akusado ay tuloy ang kaso at maconvict siya.please advise sa tutoo lang po ay kung nawala nga talaga ang baril ay nakahanda po siyang bayaran ang naturang halaga ng hulugan,pero di niya malaman ang gawin,iniisip niya na baka wanted na siya ay arestuhin siya pag pinuntahan niya ang naturang regional trial court para resolbahin ang naturang kaso,please advise what to do

a case can continue up to the point where the accused has to be arrested or he voluntarily appears in court.

i suggest that he hires a lawyer to look into the matter for him. to have the case dismissed, he has to subject himself to the jurisdiction of the court by filing bail. if the court is kind, then maybe the judge will allow the case to be mediated then dismissed.

ang gusto lang malaman ng kapatid ko ay kung siya ay wanted na o hindi pa kasi gusto niya ay siya ang personal na umayos sa kaso,nagaalangan lang siya baka pagpunta niya dun ay arestuhin na lang siya.magkano po kaya ang bail sa ganitong kaso.ang halaga po kasi ng baril 15,000 to 35,000.mainam po ba na taga batangas ang lawyer na ihire o taga metro manila.please advise

bail will be about P20000. but the court may have increased it as they normally do when the accused runs.

better to hire a local lawyer. or you can initially just have a relative visit the court to ask around.

ang warrant of arrest po ba ay pwede pong maserve dito sa kanya sa metro manila o hanggang sa area of jurisdiction lang ng ordering judge.if so pwede po ba siyang magresist kung dito sa metro manila unless walang coordination sa police authorities dito sa metro manila.sa ngayun ay nireraise pa niya ang money para sa required amount.tama po ba na ang warrant of arrest ay pwede lang iserve from monday to friday at 8 am to 5 pm lang,pwede bang magresist siya kung ito ay wala sa required regulations ng batas.please advice kasi gusto ng maayos ng kapatid ko ang kasong ito.

warrants can be enforced by any law enforcement officer at any time and at any place within philippine territory.

yes, there is a directive that they should be enforced during office hours, but that is only a guideline. the arrest is not rendered illegal if the arrest is done outside of office hours.

do not resist arrest. officers are authorized to use sufficient force to restrain the accused.

nalilito, i strongly urge you to find a lawyer to help you draft your counter-affidavit.

misappropriation in a company is an offense within the company. the fact that you were terminated does not prevent them from also filing a criminal case of qualified theft against you.

be careful of approaching them to reach a settlement. for one, if you fully paid and they still filed a case, then they really want you in jail. an offer of settlement can be used against you.

good day attorney... I need a legal advice regarding this matter

My brother in law was accused of stealing items from his employer and is now detained. The primary issue is that the company fails to give their salary and my in law and the others decided to leave the place. His bag was searched as SOP and items were found. What can we do to help him. He said he didn't do it. He never took anything from the company.

how much are the items he supposedly stole? was bail recommended? you have to go through the entire process of trial. you can also explore settlement with the company.

naiakyat na po sa piskal yung reklamo and we're waiting for the resolution. Isang modem po ang nakita sa bag ng brother in law ko. At itinama na po ng concerned na abogado yung kaso na from qualified theft ay naging theft nalang po. Ngayon po 30k ang hinihinging bail dahil po late na raw po napirmahan yung resolution kaya tumaas ng ganon. Tama po ba iyon?

if you're waiting for a resolution, where did the figure for bail come from? who is this lawyer? your brother's or for the company?
