Gusto ko lang po malaman anong pede namin gawin sa taong to. May kinukuha po kase kaming refund sa isang developer (amount is around Php 350,000.00) dahil kinansel namin yung supposed to be purchase of lot + house construction sa kanya. We cancelled it 1st week of june 2012. We agreed on the amount to be refunded by e-mail. And siya nagset ng date (thru email din po) kung kelan niya masettle full refund (he asked for at least 3 months po). Pareho po kaming overseas ni hubby so nung bakasyon namin last august, we met with him and he gave us PDC's - he split the emount into two and the dates of the cheques are 30th aug. & 30th sept. resp. Actually kahit original agreement is to settle the full amount, pumayag na din kami na split at PDC's. Sabi pa nga niya, inisplit niya para sure na makuha namin.
Iniwan namin yung cheke sa in-laws ko. Came 30th aug., nagbounce yung cheque due to insufficient funds. Sinabihan namin siya agad - pero niredeposit namin ulit cheke and nagbounce ulit. Sabi niya inaayos na daw niya cash as hindi pa lumalabas yung pera niya from the bank. Until kanina we received sms from him saying 30k lang muna mabibigay niya, so we did not accept it po. And what fed us up was nung nagtxt siya at sabi niya ' So hindi mo kukunin? Bahala ka'. The least he can do is to apologize. Pero wala. My hubby sent him sms saying na bibigyan namin siya til 1st week ng oct to settle the full refund. Pag wala, and pag nagbounce ulit yung 2 cheques pa, we'll seek legal action na (violation of BP 22). Then tumawag siya, explain siya na kesyo maswerte pa daw kami kase ibabalik niya refund to think sa other developers daw aabutin ng 1 year. Tapos me sinasabi pa siyang mapipilayan daw siya pag binalik niya yung full refund (as me mga current projects siya na siguro dun niya ginagamit pera which is ang samin lang po - labas na kami dun)..sabi pa niya bahala daw kami kung magfile kami case as aabutin daw yun 3 years...kaya hindi ko na siya kinausap pa further. Sabi ko lang ayusin niya yun till 1st week ng oct.
Tulungan nyo po kami atty. Ano po bang dapat naming gawin para mafocrce siya to give our full money back? Alam ko may means siya, pero lage niyang sinasabi na maaantala nga daw iba niyang projects pag binigay niya fully, which is unfair naman po. Pls help po. Our main concern is to have our money back...
